PILPG Author: Marisa Menezes Event Review: The Panel’s presentations focused on Sebastian Junger’s new book, War, and the accompanying documentary, Restrepo. Jennifer Khurana first discussed the American Red Cross’s mission to educate more people, particuarly students, about International Humanitarian Law (IHL). She also stressed the importance of understanding and empathizing with the realities soldiers face in the field. Andrew Carswell gave an overview of IHL, describing the four Geneva Conventions, their Additional Protocols, and how the two interact with international human rights law and domestic laws. Colonel Richard B. Jackson discussed how the United States’ approach to IHL differs from that of the International Committee of the Red Cross (ICRC). While the ICRC views these laws from the perspective of protecting civilians, the U.S. focuses on how soldiers can practically implement them on the ground. He emphasized that the U.S. government incorporates IHL into domestic law and
ensures the training of active soldiers through lectures, small unit training, and practice. Professor Gary Solis discussed the importance of books in shaping people’s perceptions of war and life. He summarized the impact many books have had on him and ultimately concluded that Junger’s War gives the best description of close quarter combat. One audience member disagreed with Colonel Jackson on certain aspects of effectively training soldiers to abide by IHL. While Colonel Jackson asserted that skilled leadership is essential to prevent violations of IHL, the audience member suggested that leaders can only mitigate violations of IHL and that soldiers will ultimately do as they please. Professor Solis argued that it is unreasonable expect 18-year-old soldiers to always exercise restraint in the excitement of the field of battle. PILPG Question & Summary of Response: A PILPGer asked a question regarding how the ICRC will attempt to implement IHL in Syria, given that the ICRC has found that an armed conflict is occurring in Syria and that President Assad said he would allow the ICRC into Syria? The speakers suggested that the ICRC has been working in the Golan Heights. Despite widespread agreement that the violence in Syria has escalated into an armed conflict, however, the organization still has not been able to gain access to Aleppo because the situation is too unstable.
